Advice please...

I am considering using two lines from a well known song as a vocal tag to a song of mine I am recording at the mo' called 'Sleep Tight'.

It's intended as an affectionate homage to the original song..However, is this legal?

The song can live without it...but it would be a nice touch.

Pretty sure you need the ok from the copyright holder, mate, otherwise 'tis illegal.

I'm no expert but I'm pretty sure you'll have to pay some monies. My cousin did a cover of Material Girl on his second album and he had to gain permission from the copyright holder and pay a fee before he was allowed to metal it up.

Speaking of Tom Petty (i.e., me, on another thread), here is section on him from Wikipedia you might find relevant:

[... Some have claimed that the Red Hot Chili Peppers single "Dani California", released in May 2006, is very similar to Petty's Mary Jane's Last Dance.[25] Petty told Rolling Stone, "I seriously doubt that there is any negative intent there. And a lot of rock 'n' roll songs sound alike. Ask Chuck Berry. The Strokes took 'American Girl' [for their song 'Last Nite'], and I saw an interview with them where they actually admitted it. That made me laugh out loud. I was like, 'OK, good for you' ... If someone took my song note for note and stole it maliciously, then maybe [I'd sue]. But I don't believe in lawsuits much. I think there are enough frivolous lawsuits in this country without people fighting over pop songs."...]

There are several examples of songs being pulled from recordings, or ceasing to be played, because they borrow lines (lyrical or musical) from other records. Oasis had to drop a track from their second album because it mimicked the guitar line of a classic song. New Order had to pay royalties on 'Run' to John Denver because of a vague similarity between tunes. More critically for your current concern, Carter USM had to delete (and stop playing) a single that included the line 'Goodbye, Ruby Tuesday'.

He should have changed it to "Bye bye Booby Tuesday" and they wouldn't have been able to touch him.

Remember the good old days, when obscenely wealthy landowners would shoot starving poachers for taking a few wild quail off their endless estates?...

Thanks guys,

Probably best if I choose an alternate route, particularly as the lines are written by the dreaded Mike Love!

.. which got me thinking - I wonder if any of you could string together a story made out of song titles? OK, I know it's childish - but what the heck, give it a go just for me!

There's a terrific recent play, 'Static' by Dan Rebellato, where a man who has died leaves behind an unlabelled mix tape for his girlfriend, and she can't make sense of the compilation in terms of either style or theme. Then she gets his best friend to identify the tracks for her, and she writes out the track titles in order...
